Pay-Per-Lead Services

1. Introduction
Home Lead Wire (“Company,” “we,” “our,” or “us”), provides pay-per-lead (PPL) marketing and lead generation services to businesses. By accessing, purchasing, or using our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions.
2. Eligibility
By using our services, you confirm that:
You are at least 18 years of age
You have the legal authority to enter into a binding agreement on behalf of yourself or your business
3. Scope of Services (Pay-Per-Lead Model)
We generate and deliver consumer inquiries (“Leads”) for agreed-upon services, locations, and criteria.
Definition of a Lead
A “Lead” is defined as:
A consumer who has submitted contact information (phone number and/or email)
Expressed interest in the specified service
Falls within the agreed geographic service area
Important Clarifications
Leads are not guaranteed to convert into sales
We do not guarantee job value, revenue, or close rate
Client is solely responsible for sales follow-up, pricing, scheduling, and conversion
Market demand, seasonality, consumer behavior, response time, and sales ability all materially affect results and are outside our control.
4. Lead Delivery & Quality
Leads are delivered electronically via email, CRM, SMS, or other agreed method
Delivery timing may vary based on demand, geography, and market conditions
We reserve the right to adjust traffic sources, creatives, and methods to optimize performance
Exclusions
The following do NOT qualify as invalid leads:
Missed calls or failure to answer
Delayed follow-up
Consumer choosing another provider
Price objections
No-shows
“Just shopping around”
Not ready to proceed
Deciding to postpone service
5. Lead Replacement Policy (If Applicable)
At our discretion, we may replace leads that are:
Disconnected numbers
Clearly outside the agreed service area
Wrong service category
Replacement requests must be submitted within 48 hours of lead delivery with supporting evidence.
Replacement of leads is the sole remedy available.
6. Payment Terms
Pricing is based on a pay-per-lead fee, as outlined in your agreement
Payment is due in advance or upon delivery, depending on arrangement
Late payments may result in:
Immediate pause of lead delivery
Interest charges of up to 15% per month
Termination of service
7. NO REFUND POLICY
ALL PAYMENTS ARE FINAL.
No refunds, chargebacks, or reversals will be issued for any reason, including but not limited to:
Lead performance
Conversion rates
Sales outcomes
Business closures
Internal staffing issues
Dissatisfaction with results
By purchasing our services, you acknowledge that marketing and lead generation involve risk and that outcomes are not guaranteed.
8. Client Obligations
You agree to:
Respond promptly to leads
Maintain a working phone number and intake process
Follow applicable laws and regulations
Communicate respectfully and professionally
Failure to meet these obligations voids any eligibility for lead replacement and may impact results.
9. Confidentiality
Both parties agree to keep confidential:
Business processes
Pricing
Campaign strategies
Proprietary systems and data
Unauthorized sharing or misuse of our materials is strictly prohibited.
10. Intellectual Property
All systems, campaigns, ads, creatives, processes, scripts, and methodologies remain the exclusive intellectual property of Home Lead Wire, unless otherwise stated in writing.
You may not:
Replicate
Resell
Reverse engineer
Share proprietary materials
11. Termination
Either party may terminate with 1 day written notice, unless otherwise stated.
Upon termination:
All outstanding balances remain due
Access to systems, tools, and services will be revoked
No refunds will be issued for unused or undelivered leads
12. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential damages
Total liability is limited to the amount paid for leads in the prior 30 days
13. Indemnification
You agree to indemnify and hold harmless Home Lead Wire from any claims, damages, or liabilities arising from:
Your use of the leads
Your business operations
Failure to comply with laws or regulations
14. Third-Party Platforms
We may use platforms such as Google, Meta (Facebook/Instagram), SMS providers, or CRMs. We are not responsible for:
Platform outages
Policy changes
Account suspensions
Third-party compliance requirements
15. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Massachusetts, without regard to conflict-of-law principles.
17. Dispute Resolution
All disputes shall be resolved through binding arbitration in Waban, Massachusetts, except where prohibited by law.

SMS Communications
By providing your mobile phone number to Home Lead Wire, you consent to receive text messages (SMS and MMS) from us, our affiliates, and our authorized partners and service providers. These messages may be sent using automated technology, including autodialers, automated messaging systems, or artificial intelligence–assisted messaging platforms, where permitted by law.

20. Opt-Out and Assistance
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive. Upon receipt of your opt-out request, you will no longer receive SMS messages from the sender, except as required for administrative or transactional purposes where permitted by law.

21. Message and Data Rates
Standard message and data rates may apply to any SMS or MMS messages sent or received in connection with our services. These charges are billed by and payable to your mobile carrier and are subject to the terms and conditions of your mobile service plan.
Charges may vary depending on your carrier, service plan, geographic location, and whether the message is sent domestically or internationally. Home Lead Wire and its affiliates and partners do not charge for sending or receiving SMS messages but are not responsible for any messaging or data charges imposed by your mobile carrier.
You are solely responsible for all fees and charges associated with SMS messages sent to or received from us or our partners.
22. Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and may be limited by network availability, carrier filtering, or other factors outside our control.
